What is hacking in law?

 

Hacking computer is the term that is most famous in computer science that is an act to gain access to the computer without having password by tricking computer but in law, we do not have this term we call that the unauthorized access and use of computers and computer networks so what is this?

To have an idea we have to get back in 1980 in united states where all of this began there was the years were the age of computer began with a network white known party some university and government agency but all the user where well known there was no ordinary user but in this hears they become accessible to the publics because the internet had known user there was built with minimum security but as it become public, this raise some problems but what put this in discussion is the famous movie that come in 1983 named the game of war where is tell a story of a student who like to play games and have Somme background in computer science so he decide to play the last game of some company and try to enter his computer by guessing the password but accidentally enter to a computer own by an agency of government and that computer responsible for nuclear missile this idea have scaring the public and for that Congress of united states included the computer fraud act in 1984 in this act we hear about the term the unauthorized access and use of computers and computer networks for the first time the main conserve of this law is to save the governments computer but it can apply to all computer but he don’t present any definition of what it called the unauthorized access and use of computers and computer networks so we must wait for the court to define it so first they said that the computer is reserved to a group of people and when someone outside this group access to that computer this is necessary to access whiteout authorization than the definition to even when there is some authorization there is no authorization when the defender access to the computer for reason that is against the interest of the owner of computer that call Exceeding Authorized Access  or when someone access to the computer against the contract of service for example email contract of service for example they punish o woman ho open account of Myspace with the name that is not his 

So this is the first law in hacking and was inspired by a lot of states including France.

So just access to the computer without authorization is a crime but if the hacker damaged the computer that will be other crimes 

And just trafficking with a password is a crime but a separate offense we will discuss in another post
